Benjamin Clayton has successfully obtained an award of damages for a prisoner injured in an assault by prison officers.

The claim involved the use of control and restraint procedures utilised by prison officers, after the prisoner refused to comply with an order to return to his cell.  It was alleged that the Prisoner had tried to punch an officer, but this was not accepted by the court.

The Claimant alleged that the use of force amounted to an assault, which was upheld by the court.

It was held that the decision to restrain was not reasonable or justifiable in the circumstances of the case and therefore the actions of the officers amounted to a battery.
